Miscellaneous Criminal Application / Ruling on Application for Leave to Appeal Out of Time

  1. 1 Whether the applicant should be granted leave to appeal out of time against conviction and sentence for robbery with violence.
  2. 2 Whether the absence of sentencing date details precludes the grant of leave.

Ratio Decidendi

The court found that although the applicant did not specify the date of sentence, this omission was excusable given his unrepresented status. The court determined that no prejudice would be occasioned to the prosecution by granting leave to appeal out of time. Accordingly, the application for enlargement of time to file an appeal against the conviction and sentence in Winam SPM Criminal Case No E998 of 2021 was allowed. The applicant was granted 14 days from service of the order to file the appeal, which must be accompanied by a copy of the warrant of commitment to prison sentence showing the date of sentencing.
