The 2nd defendant's unchallenged affidavit evidence established that he would suffer substantial loss if evicted and that the plaintiff was not in occupation of the land and might dispose of it. The plaintiff did not file a replying affidavit to rebut these averments, and grounds of opposition alone were insufficient.
