The Tribunal accepted the landlord's assertion of intent to renovate, supported by approaches from financial institutions. The Tribunal also determined that the tenants had already recouped their construction investment over the lease period, and that the tenancy relationship was not substantively restored after the initial eviction, as the tenants delayed seeking a stay and were not in possession for a significant period.
