  1. 1 Whether the applicant is entitled to judgment on the certificate of costs issued by the taxing master.
  2. 2 Whether interest at 14% per annum from 23rd March 2023 is payable on the taxed costs.
  3. 3 Whether the applicant is entitled to costs of the application.

Ratio Decidendi

The court found that the applicant's advocate-client bill of costs had been taxed and a certificate of costs issued, which had not been challenged or set aside by the respondent. Section 51(2) of the Advocates Act provides that such a certificate is final as to the amount unless altered by the court. Since the retainer was not disputed and the respondent failed to respond or contest the application, the applicant was entitled to judgment for the certified sum. The court also found that the applicant was entitled to interest at 14% per annum from 23rd March 2023, being 30 days after delivery of the bill of costs, until payment in full, as well as the costs of the application.
