Consequently, the registration of Eliud Wekesa Waswa as proprietor of Kakamega/Lumakanda/186 was invalid and liable to be cancelled. The plaintiff's claim, being based on an invalid title, could not succeed. The defendant, having established that his title was unlawfully cancelled, was entitled to restoration of proprietorship.
