The court found that the applicant failed to provide a certificate of delay from the Deputy Registrar and did not prove service of the letter bespeaking proceedings on the respondents. These omissions are fatal because, under Rule 82(1) and (2) of the Court of Appeal Rules, only a party who both requests proceedings in writing and serves that request on the respondent can benefit from the exclusion of time taken to prepare proceedings from the 60-day period for filing a record of appeal.
