The court found that the Plaintiff in the current suit was not a party to Machakos ELC No. 366 of 2009, nor were his specific land titles referenced or adjudicated in that earlier judgment. Although the Plaintiff may have acquired his plots through Kasina Housing Scheme Society, the previous suit did not enumerate individual members or address the Plaintiff's titles. The court held that the parties and subject properties in the present suit are different from those in the previous suit. Therefore, the doctrine of res judicata does not apply, and the application to dismiss the suit on that ground is unmeritorious.
