Although the Plaintiffs' counsel did not provide specific reasons for seeking cross-examination, the principle of fair trial requires that both parties be afforded equal opportunity to challenge affidavit evidence. Since the Defendants were allowed to cross-examine the Plaintiffs' witness, fairness dictates that the Plaintiffs should also be allowed to cross-examine the 1st Defendant on his affidavits.
