The High Court found that the trial court's award of Kshs 400,000/- as general damages for moderately severe soft tissue injuries was considerably high and not supported by comparable authorities, where awards for similar injuries ranged between Kshs 150,000/- and Kshs 300,000/-. The trial court failed to adhere to the principle of uniformity and comparability in the assessment of damages, resulting in an excessive award. This constituted an error in principle, justifying appellate interference. The High Court therefore set aside the award of Kshs 400,000/- and substituted it with Kshs 250,000/- as general damages, while upholding the rest of the trial court's judgment.
