Procedural Posture

Employment Cause / Judgment

  1. 1 Whether the claimant's termination from employment was unfair and contrary to the Employment Act, 2007.
  2. 2 Whether the claimant was entitled to sick leave and whether proper procedure was followed in his absence from work.
  3. 3 Whether the claimant is entitled to notice pay and compensation for unfair termination.

Ratio Decidendi

The court found that the claimant's termination was procedurally unfair because the respondent failed to provide notice, reasons, or a hearing as required by sections 41 and 45 of the Employment Act, 2007. Although the claimant did not provide a medical certificate as required under section 30 for sick leave, the respondent did not contest the claim or provide any evidence to justify the termination. The absence of a defence and the failure to follow statutory procedure rendered the dismissal unfair. The claimant was therefore entitled to notice pay and compensation for unfair termination, but not the full twelve months claimed; instead, three months' gross wage was deemed appropriate.

Court Disposition

Judgment for the claimant.
