Ratio Decidendi

The trial of the appellant was conducted by police prosecutors who were not qualified under Section 85(2) of the Criminal Procedure Code, rendering the entire proceedings a nullity. The conviction and sentence imposed by the trial magistrate were therefore set aside and quashed. In determining whether to order a retrial, the court considered the appellant's prolonged incarceration since 1/1/2000, the nature of the offence, and his age at the time of the alleged offence. The court concluded that it would not serve the interests of justice to order a retrial and accordingly discharged the appellant, ordering his immediate release unless otherwise lawfully held.
