Procedural Posture

Stay Application / Ruling on Application for Stay of Execution Pending Appeal

  1. 1 Whether the applicant is entitled to an order for stay of execution pending appeal.
  2. 2 Whether the applicant has demonstrated sufficient cause for grant of stay.
  3. 3 Whether the applicant has shown willingness to provide security for costs.

Ratio Decidendi

The court found that although the application for stay of execution was filed expeditiously, the applicant had not filed a substantive appeal more than seven months after judgment. Without a Memorandum of Appeal, the court could not determine whether there was an arguable appeal. The applicant also failed to demonstrate sufficient cause or willingness to provide security for costs. Consequently, the application was not anchored on any pending appeal and lacked merit. The only satisfied condition was timely filing, which alone was insufficient to warrant the grant of stay. The application was therefore dismissed with costs to the respondent.

Court Disposition

application dismissed with costs to the respondent

Orders

  • The application for stay of execution pending appeal is dismissed.
  • Costs awarded to the respondent.
