Miscellaneous Application / Judgment

  1. 1 Whether the restriction placed on the applicant's property was lawful and procedurally fair.
  2. 2 Whether the applicant is entitled to removal of the restriction on Thika Municipality Block 29/378.
  3. 3 Whether the respondents followed due process in restricting the applicant's property rights.

Ratio Decidendi

The court found that the applicant had demonstrated it was the registered proprietor of the suit property and held a valid lease. The respondents, despite being given an opportunity, failed to justify the restriction or provide any legal basis for maintaining it. The court held that the applicant's rights under Article 40 of the Constitution and the Land Registration Act should be protected, and that due process had not been followed by the respondents in placing the restriction. Consequently, the court granted the removal of the restriction as sought by the applicant.
