Procedural Posture

Notice of Motion / Ruling on Application for Joinder of Interested Parties

  1. 1 Whether the proposed interested parties are necessary parties for the complete adjudication of the dispute over L.R. No. 12715/155.
  2. 2 Whether the applicants have demonstrated a sufficient legal interest in the suit property to warrant their joinder.
  3. 3 Whether the absence of executed and attested sale agreements precludes the applicants from being joined as parties.

Ratio Decidendi

The court found that the applicants, despite claiming to have purchased portions of the suit property, failed to produce executed and attested sale agreements as required by Section 3(3) of the Law of Contract Act. They are not registered proprietors of the land, and their interests, if any, are sufficiently represented by the 8th, 9th, and 10th Defendants who are already parties to the suit. The court held that the applicants are not necessary parties for the complete adjudication of the dispute, as their presence would not assist in determining the ownership of L.R. No. 12715/155. Consequently, the application for joinder was dismissed with costs.

Court Disposition

Orders
