Procedural Posture

Temporary Injunction Application / Ruling on Interlocutory Application

  1. 1 Whether the applicant has established a prima facie case for grant of a temporary injunction.
  2. 2 Whether the applicant will suffer irreparable injury if the injunction is not granted.
  3. 3 Where the balance of convenience lies between the parties in the context of the boundary dispute.

Ratio Decidendi

The court found that while there is a boundary dispute between plot No. 51 and plot No. 52 (and partly plot No. 53), the applicant failed to demonstrate irreparable injury that could not be compensated by damages. The defendant has been in occupation of the disputed area for a considerable period, and the balance of probabilities does not favor granting a temporary injunction as sought. Instead, the court determined that the appropriate course is to maintain the status quo, preventing further developments or eviction on the suit property until the suit is heard and determined. The application for a temporary injunction was therefore not granted, and costs were ordered to be in the cause.

Court Disposition

Application for temporary injunction dismissed; status quo to be maintained.

Orders

  • No further developments to be undertaken on the suit property until hearing and determination of the suit.
  • No person to be evicted from the suit property until hearing and determination of the suit.
