Civil Case / Judgment

  1. 1 Whether the plaintiff is entitled to be declared the rightful owner of 1.5 acres of Kericho/Kapsuser/4048 by purchase or adverse possession.
  2. 2 Whether the transaction between the plaintiff and defendant is void for lack of Land Control Board consent under the Land Control Act.
  3. 3 Whether the plaintiff is entitled to specific performance or refund of purchase price.

Ratio Decidendi

The court found that although the plaintiff had entered into written agreements with the defendant, paid the full purchase price, and taken possession of the land, the transaction concerned agricultural land in a controlled area and was therefore subject to the Land Control Act. No consent from the Land Control Board was obtained within the statutory period, rendering the transaction void for all purposes under Section 6(1) of the Act. Court Disposition

plaintiff's suit dismissed; refund of purchase price with interest ordered; no order as to costs.

Orders

  • The plaintiff's suit is dismissed.
  • The defendant shall refund the purchase consideration of Ksh. 11,500 to the plaintiff with 14% interest per annum from the date of payment.
