Ratio Decidendi

The court found that the Respondent failed to provide any written or oral evidence that the Claimant absconded from work in November 2014. The only documented desertion was in 2013, for which the Claimant apologized and was re-employed. In the alleged 2014 desertion, the Respondent did not demonstrate any attempt to contact the Claimant or convene a disciplinary hearing as required by Section 41 of the Employment Act. The court held that the Respondent did not comply with statutory requirements for fair termination and failed to justify the dismissal. Consequently, the Claimant was found to have been unlawfully terminated and entitled to compensation.
