Criminal Appeal / Ruling at Close of Prosecution Case

  1. 1 Whether the prosecution established a prima facie case against the accused to require him to make a defence.
  2. 2 Whether there was sufficient evidence linking the accused to the cause of death of the deceased.
  3. 3 Whether the absence of medical evidence as to cause of death is fatal to the prosecution's case.

Ratio Decidendi

The court found that while there was evidence of a fight between the accused and the deceased resulting in injury and subsequent hospitalization, there was no medical evidence establishing the cause of death. The prosecution failed to prove that the deceased died as a result of the accused's actions. The absence of such evidence created a gap that could not be filled by speculation or by hoping the defence would address it. Consequently, the prosecution did not establish a prima facie case to require the accused to make a defence, and the accused was entitled to an acquittal under Section 306(1) of the Criminal Procedure Code.
