Civil Suit / Ruling on Objectors' Application to Set Aside Eviction Order

  1. 1 Whether the eviction order issued in respect of the suit properties extends to land parcels owned by the objectors and the interested party.
  2. 2 Whether the objectors and the interested party are entitled to protection from eviction where their parcels of land are not among the suit properties.
  3. 3 Whether the court can re-open the case to trace the history of the objectors' parcels of land.

Ratio Decidendi

The court found that the eviction order issued after dismissal of the plaintiffs' suit was expressly in respect of land parcels West Mugirango/Siamani/3991, 3992, 3993, 3994, and 3995, and did not extend to the parcels owned by the objectors and the interested party (West Mugirango/Siamani/4292 and 5500). The objectors' parcels were not among the suit properties, and the objectors were not parties to the original suit. Consequently, the execution and eviction orders could not lawfully be enforced...
