There was also no evidence that he was the legal representative of the deceased plaintiff's estate or that he had accepted substitution. The consent order was therefore impugned and its legality questionable. The court held that the consent order dated 23rd April, 2013 and all subsequent pleadings filed with William Otiende Didi as plaintiff should be set aside and expunged from the record.
