The court found that the Kisumu East District Land Disputes Tribunal ceased to exist in law as of 30th August 2011 following the repeal of the Land Disputes Tribunal Act by the Environment and Land Court Act. The tribunal's award, delivered on 13th September 2011, was therefore made by a body that no longer had legal existence, rendering the decision null and void. Furthermore, even if the tribunal had still existed, its jurisdiction under Section 3(1) of the repealed Act did not extend to matters of title to registered land.
