Ratio Decidendi

The court found that although the applicants delayed for about seven months in filing the application for leave to appeal, the delay was explained by the absence of notice regarding the delivery of the ruling. The court held that the right to appeal is constitutional and, in the interests of justice, granted leave to file the appeal out of time. However, the court determined that the ruling sought to be stayed was a negative order, merely dismissing the applicants' application with costs and not requiring any party to do or refrain from doing anything. As such, there was nothing to stay, and the prayer for stay of execution was denied. Each party was ordered to bear its own costs.
