This brought the matter within the jurisdiction of the Environment and Land Court. Furthermore, the applicant failed to raise the issue of jurisdiction at the earliest opportunity and delayed unreasonably in seeking review, contrary to the requirements of Order 45 Rule 1 of the Civil Procedure Rules.
