Ratio Decidendi

The court found that the applicant lodged the notice of appeal 30 days after the dismissal of the suit, contrary to the 14-day period stipulated by Rule 74(2) of the Court of Appeal Rules. In the absence of any order granting leave to file the notice of appeal out of time, there was no competent appeal pending. As a result, the substratum of the application for stay of execution did not exist, rendering the application incompetent. The court therefore struck out the motion without considering its merits, holding that the application was without foundation in law.
