The court found that although the applicant's counsel had repeatedly failed to comply with procedural requirements, the interests of justice warranted granting a final opportunity to pursue the appeal. The absence of certified translations in the trial record was a procedural lapse, but the applicant could seek leave to adduce additional evidence under rule 29(1)(b) if necessary. Exercising discretion under rule 4, the court extended the time for filing the notice of appeal by 7 days and the record of appeal by 21 days from the date of lodging the notice. Costs of KES 3,000 were awarded to the respondent, payable within 30 days, failing which execution would ensue.
