No proof was produced of the Claimant's admission or of a fair disciplinary process, such as minutes or documentation of a hearing. The requirements of Sections 41 and 43 of the Employment Act were not met, as the Claimant was not accorded a fair hearing nor was a valid reason for termination established. Consequently, the dismissal was declared unfair and unjustified.
