Procedural Posture

Land and Environment Case / Judgment

  1. 1 Whether the transfer of LOC 2/GACHARAGE/790 to the 1st Defendant was fraudulent and illegal.
  2. 2 Whether the titles arising out of LOC 2/GACHARAGE/790 should be cancelled.
  3. 3 Whether the 2nd Defendant is a bona fide purchaser of LOC 2/GACHARAGE/3820.

Ratio Decidendi

The Court found that the transfer of LOC 2/GACHARAGE/790 to the 1st Defendant was illegal and fraudulent, as it occurred after the death of the registered owner without succession proceedings or a grant of representation, contrary to section 45 of the Law of Succession Act. The Land Dispute Tribunal lacked jurisdiction to determine title to registered land, rendering its orders and subsequent transactions null and void. The subdivision and transfer of the resultant parcels, including the sale to the 2nd Defendant, were therefore invalid. The 2nd Defendant was not a bona fide purchaser for value, having failed to conduct proper due diligence and acquire consent from all beneficiaries....

Court Disposition

Plaintiff's and 2nd Defendant's claims partially succeed; 1st Defendant's titles and subdivisions cancelled; 2nd Defendant awarded refund; costs to Plaintiff and 2nd Defendant.

  • Subdivisions LOC 2/GACHARAGE/3818-3820 made by the 1st Defendant are declared null and void.
