The proceedings and orders in Oyugis Miscellaneous Civil Application No. 38 of 2021 were therefore a nullity. The subordinate court lacked jurisdiction to entertain the application, and the assessment of auctioneer's fees in those proceedings was invalid. The appeal was allowed with costs to the appellants.
