Ratio Decidendi

The court found that the present application for stay of execution pending appeal was distinct from the earlier application to set aside judgment, and therefore the court was not functus officio nor was the matter res judicata. The 1st defendant raised a legitimate concern regarding the plaintiff's ability to refund the decretal sum if the appeal succeeded, and the plaintiff did not rebut this concern. The court exercised its discretion to grant a stay of execution to avoid substantial loss, on condition that the 1st defendant deposits the decretal sum in an interest earning account in the names of both parties' advocates within 30 days. Costs were reserved for the appeal.
