The court held that the general rule is that costs follow the event, and there was no good reason to depart from this principle. Although the defendant argued that both parties were successful and that the suit was not prosecuted, the court found that the plaintiff had to file suit and instruct counsel due to the defendant's delay in fulfilling contractual obligations. The act of filing the suit constituted prosecution of the claim. The defendant's admission came only after the suit was filed, and had he complied with the agreement earlier, litigation would have been unnecessary. Therefore, the plaintiff, as the successful party, is entitled to costs.
