The court found that while the applicant's counsel explained that instructions to appeal were given late, the applicant herself did not provide an explanation for the delay in giving those instructions. Despite this, the court exercised its discretion in favour of the applicant, considering the interests of justice and the absence of opposition from the respondent. The court granted leave to appeal out of time, extending the period for filing the appeal by 30 days from the date of the ruling. The costs of the application were ordered to abide the outcome of the appeal.
