The court found that the preliminary objection did not raise a pure point of law, as determining whether the petition was authorized by a company resolution or whether the deponent had authority would require factual inquiry and examination of evidence. There is no express legal requirement for a board resolution to be filed with a constitutional petition, and such technicalities are not grounds for striking out a petition, especially in light of Article 159(2)(d) of the Constitution, which mandates that justice be administered without undue regard to procedural technicalities.
