The court determined that it was unable to deliver judgment in the appeal because the lower court file, which forms part of the record of appeal, was not before it. Without the lower court file, the court could not properly consider the merits of the appeal or prepare a judgment. The court therefore directed the Deputy Registrar to facilitate the retrieval of the lower court file (Mombasa SRMCC Case No. 13 of 2011) to enable the court to proceed with the delivery of its judgment. The matter was set for mention to give further directions once the file is availed.

Although I was supposped to deliver a judgment today when I began to consider my judgment I found that the lower court file was not attached to this appeal. Accordingly I could not prepare the judgment.
I request the Deputy Registrar to assist in having the court file in Mombasa SRMCC Case No. 13 of 2011 brought to this court to enable this court deliver it's judgment.
To that end this court at the reading of this Ruling will give a mention date to enable the court give further directions.
