Upon analysis, the court held that the loan facilities in question were subject to the six-year limitation period under Section 4(1) of the Limitation of Actions Act. However, the Defendants' written acknowledgments of the debt in 2013 and 2015, made before the expiry of the limitation period, effectively reset the limitation period under Section 23 of the Act.
