Ratio Decidendi

The High Court determined that while it has the power under Section 18 of the Civil Procedure Act to withdraw and transfer suits from subordinate courts to itself or to other competent subordinate courts, it does not have the power to transfer a suit from a subordinate court to the Industrial Court. This is because the Industrial Court, established under Article 162(2)(a) of the Constitution, has the same status as the High Court and is not subordinate to it. Therefore, the High Court cannot withdraw a suit from a subordinate court and transfer it to the Industrial Court.
