Ratio Decidendi

The High Court at Mombasa has jurisdiction to hear and determine the application for enforcement of a judgment delivered by the Court of Appeal at Kisumu because enforcement proceedings are distinct from the original suit, and the government, through the Attorney General, is present throughout Kenya. Section 12(e) of the Civil Procedure Act applies only to the institution of the original suit, not to enforcement actions. The rules regarding the filing location of High Court matters are administrative and do not limit the court's jurisdiction.
