The Tribunal found that the suit was not res judicata as the issues in CTC. No. 10/2016 were distinct and there was no evidence of a final determination on the merits regarding the Claimant's indebtedness. The Claimant failed to prove repayment of the loan, and the loan statement showed an outstanding balance as at April 2016. The Respondent was therefore entitled to recover the outstanding loan from the Claimant's shares. Although the Respondent did not produce evidence of issuing the required notice under Rule 30 of the Co-operative Society Rules, the absence of such proof was not fatal to its case given the established loan arrears.
