The court held that the application for joinder by the 2nd Respondent was made after the Kadhi's Court had already heard and determined the matter, and thus could not be entertained. The law on joinder of parties, as set out in Order 1 Rules 3 and 10 of the Civil Procedure Rules, contemplates the addition of parties to an ongoing suit, not after judgment has been delivered. The 2nd Respondent's interest in the property arose only after the judgment, and there was no evidence that the applicants were informed of or consented to the sale of the share.
