The High Court determined that it lacks jurisdiction to grant leave to appeal out of time against its own decision in a criminal matter. The power to extend time for filing an appeal from the High Court lies exclusively with the Court of Appeal, as provided under Article 164(3) of the Constitution and Section 349 of the Criminal Procedure Code. Applications for enlargement of time to appeal must be made to the court to which the appeal is intended, in this case, the Court of Appeal. The application before the High Court was therefore misconceived and improperly before the court, warranting its striking out.
