The court found that although there was deliberate evasion by the Defendant in accepting service of court process, the Plaintiff's agent in Kenya, Agro Irrigation & Pump Services Ltd, was not properly authorized by the Plaintiff company to swear affidavits or verify the plaint. The Power of Attorney was granted to the company, not to the individual deponent, Mr. Mahesh Halai. This defect was material and warranted setting aside the default judgment. The court exercised its discretion to allow the Defendant's application, struck out the defective verifying affidavit, and directed the Plaintiff to file a fresh verifying affidavit by a properly authorized deponent within 60 days.
