The court found that the consent order entered on 16th February 2017 was based on a mutual mistake by both parties' advocates in calculating the interest due on the principal sum. Instead of using the correct period of 36 months from 5th February 2014 to 16th February 2017, the advocates used 26 months, resulting in an under-calculation of the interest. Given that the applicant had a judgment for a specific sum plus interest, and there was no explanation for consenting to a lesser amount, the court held that the mistake was material and justified setting aside the consent in respect to the sum. The court substituted the consented sum with the correct amount reflecting interest for 36 months.
