The Court held that the appeal would be rendered nugatory if stay was not granted, given the substantial amount claimed and the risk that the suit would proceed to hearing and determination before the appeal was resolved. The Court was satisfied that the applicant met both limbs required for the grant of stay under rule 5(2)(b) of the Court of Appeal Rules. Accordingly, the Court granted a stay of execution of the High Court's ruling, orders, and all subsequent proceedings pending the hearing and determination of the appeal.
