The court held that the declaration of KS 1515:2000 as a Kenya Standard and its operationalization through Gazette Notice 1924 and Legal Notice 69 complied with the procedure set out in Sections 9(1) and 9(2) of the Standards Act. The Act does not require the full text of the Standard to be published in the Gazette, only a formal declaration. Subsidiary legislation made under these sections is exempt from the requirement to be laid before Parliament under Section 34 of the Interpretation and General Provisions Act.
