Procedural Posture

Tribunal Claim / Judgment

  1. 1 Whether the Claimants served valid Notices of Withdrawal upon the Respondent.
  2. 2 Whether the Claimants are entitled to a refund of their individual shares as claimed.

Ratio Decidendi

The Tribunal found that the Claimants had served valid withdrawal notices on the Respondent and provided documentary evidence of their share balances. The Respondent failed to produce any evidence of outstanding liabilities or to rebut the Claimants' evidence. The Tribunal held that the Claimants had established their entitlement to refunds on a balance of probabilities. The Respondent's mere denial, unsupported by evidence, was insufficient to defeat the claim. Accordingly, judgment was entered in favour of the Claimants for the total sum claimed, with interest and costs.
