Ratio Decidendi

Therefore, the conviction on the alternative count was irregular. The magistrate should have entered a plea of not guilty and proceeded to hear evidence. The sentence imposed was also irregular and harsh for a first offender. Exercising its revisionary powers under section 364 of the Criminal Procedure Code, the High Court quashed the conviction and set aside the sentence, ordering the applicant's release unless otherwise lawfully held and refund of any fine paid.
