The court found that the respondent's cause of action accrued no later than 15th July 1998, being the date by which payment for the last supply was contractually due. The suit, filed on 4th September 2006, was therefore brought outside the six-year limitation period prescribed by section 4(1) of the Limitation of Actions Act. The court held that there is no jurisdiction to extend time for actions founded on contract, and any leave purportedly granted to file the suit out of time was a nullity. The trial court erred in failing to address the limitation issue, which goes to the root of jurisdiction.
