The subsequent registration of the 1st defendant as proprietor and issuance of a title deed was therefore without legal basis. The court held that the award and decree adopted by the court in favour of Alice Musimbi did not affect the plaintiff's land, and the title deed issued to Alice Musimbi was a nullity.
