In accordance with Section 10(7) of the Employment Act, the burden of disproving the claimant's terms fell on the respondent, who failed to discharge it. The court accepted the claimant's version that he was employed from 2008 to 2013 and was paid Kshs. 435 per day. The court further held that the claimant was not given notice, a hearing, or subjected to any disciplinary process prior to termination, in breach of Section 41 of the Employment Act.
