Ratio Decidendi

The court held that it lacks jurisdiction to transfer a judgment from the subordinate court to itself for execution purposes where the suit has already been heard and determined. Section 18(1) of the Civil Procedure Act only permits transfer of pending suits or proceedings, not concluded ones. Furthermore, the subordinate court judgment did not assess or award general damages as sought by the applicant; only costs and interest were awarded. Therefore, even if the judgment were transferred, there would be no executable award for general damages. The application was thus found to be without merit and dismissed.
