The High Court found that the trial magistrate erred by imposing the maximum sentence of 10 years imprisonment without considering that the appellant was a first offender, had pleaded guilty, and was found with a small quantity of cannabis sativa valued at Kshs 120/-. The law provides for a maximum, not a mandatory, sentence, and the absence of previous convictions should have been treated as a mitigating factor. The appellate court exercised its discretion to set aside the custodial sentence and substituted it with a fine of Kshs 10,000, or in default, six months imprisonment, holding that the original sentence was manifestly excessive in the circumstances.
